Please read these Terms of Service ("Terms") carefully before using AskMyBio.ai, operated by Centsible Consulting LLC("we", "us", or "our"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Description of Service

AskMyBio.ai is a creator commerce platform that allows content creators ("Creators") to connect their online stores, manage products, and deploy an AI-powered shopping assistant on their bio link page. The platform enables visitors to discover and purchase products through a conversational interface.

2. Eligibility

You must be at least 18 years old to use AskMyBio.ai. By using the Service, you represent and warrant that you meet this requirement and have the legal capacity to enter into these Terms.

3. Account Registration

To access the Service, you must create an account. You agree to:

• Maintain the security of your password and account
• Notify us immediately of any unauthorized use of your account
• Accept responsibility for all activities that occur under your account

5. Creator Responsibilities

As a Creator using AskMyBio.ai, you are solely responsible for:

• All products and content you list, promote, or sell through the platform
• Compliance with all applicable laws governing your products and sales
• Accurate product descriptions, pricing, and availability
• Fulfilling orders placed through your storefront
• Obtaining all necessary licenses and permissions for content you upload
• Your use of connected third-party platforms (Shopify, Facebook, Instagram, etc.) in accordance with their respective terms

6. Third-Party Integrations

AskMyBio.ai integrates with third-party services including Facebook, Instagram, Shopify, and others. Your use of these integrations is subject to the terms and policies of those third parties. We are not responsible for the availability, accuracy, or practices of third-party services. You grant us permission to access and use data from connected accounts solely to provide the Service features you have enabled.

Specifically regarding Facebook and Instagram: our platform's use of Meta platforms APIs is subject to Meta's Platform Terms and Developer Policies. We only request permissions necessary to provide the features you enable, and we handle that data in accordance with our Privacy Policy.

7. AI-Powered Features

AskMyBio.ai uses artificial intelligence to power the shopping assistant on your bio page. The AI assistant is intended to help visitors discover and learn about your products. You acknowledge that:

• AI responses are generated automatically and may occasionally be inaccurate
• You are responsible for reviewing your AI agent's training data and behavior
• We do not guarantee specific sales outcomes or conversion rates
• AI features are provided "as-is" and may be updated or modified over time

8. Fees and Payment

AskMyBio.ai offers subscription plans with varying features. By subscribing, you agree to pay all applicable fees as described on our pricing page. Additionally, we charge a 1% revenue share on sales volume processed through the platform. All fees are non-refundable except as required by law or as explicitly stated in our refund policy. We reserve the right to change pricing with 30 days' notice.

9. Intellectual Property

The AskMyBio.ai platform, including its design, code, features, and branding, is owned byCentsible Consulting LLC and protected by intellectual property laws. You retain ownership of content you upload to the platform. By uploading content, you grant us a limited, non-exclusive license to use that content solely to provide the Service.

You may not copy, modify, distribute, or reverse engineer any part of the Service without our prior written consent.

10. Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand our data practices.

11. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CENTSIBLE CONSULTING LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS OR DATA, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM.

13. Indemnification

You agree to indemnify and hold harmless Centsible Consulting LLC, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including attorneys' fees) arising from your use of the Service, your content, your products, or your violation of these Terms.

14. Termination

We may suspend or terminate your account at any time for violation of these Terms, with or without notice. You may cancel your account at any time from your account settings. Upon termination, your right to use the Service ceases immediately. Sections 9, 11, 12, and 13 survive termination.

15. Governing Law

These Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Delaware, and you consent to personal jurisdiction in those courts.

16. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the Service after changes constitutes acceptance of the new Terms.
